If you are in default, close to being in default, or have been sued in foreclosure, YOU MAY NOT HAVE TO LOSE YOUR HOME. Call our office immediately to schedule a free consultation today to make sure that you don’t miss out on any of the many remedies available to you. The sooner you take action, the greater the chances you have to save your home. Don’t wait until it’s too late!
What to bring:
Please bring all closing documents you received in reference to your mortgage or any home equity loans. Please also bring a list of your income, expenses, and other debt you have in addition to your home. We will discuss the specific circumstances surrounding the purchase or refinance of your home and go over your possible options. If you have been sued, please bring all of those papers as well.
You may be able to challenge a foreclosure if the lender did not follow proper procedure in the foreclosure process, including filing certain documents with the court and providing the borrower with notice.
You may also be able to challenge the validity of the original mortgage agreement or on the conduct of the lender.
You may be able to receive a mortgage modification.
Other options for saving your home from foreclosure include negotiating a workout agreement or filing for Chapter 13 bankruptcy.
Depending on the circumstances, we will recommend a certain course of action. Those options include the filing of a Chapter 13 bankruptcy or a state law foreclosure defense.
If you have a bad loan with terms you cannot afford, you may want to defend against the foreclosure. We will answer the Complaint and may raise counterclaims and affirmative defenses (Note: You must Answer the Complaint within 20 days of the date of service of the foreclosure paperwork!). This will slow down the foreclosure process.
